Custodial Arrangements

Custodial arrangements are agreements for the custody of children subjected to a family law action, usually by parents who are in the process of divorcing. Some parents can have sole custody of their children while the non-custodial parent may be required to pay child support as part of the custodial arrangements.

In many arrangements, parents can come to an agreement of shared, split or joint custody of their children. A judge who has to make a ruling on these kinds of arrangements may award child support on the basis of the custodial arrangement. There are many variables as to what support is to be paid based on the custodial arrangements.

Although the child support guidelines provide the basis of what could be paid to a recipient parent per month, the additional variables may come into the picture based on the custodial arrangements that are put in place. How much time children in these circumstances will spend with parents could be the final line in how much support is awarded to a parent who will be in receipt of support payments. Judges are expected to be fair in these circumstances and proceed with calculations in a reasonable manner based on what is presented before them. When these matters are contested before the court, they are required to balance the custodial arrangements properly with all the financial circumstances of the parents and the set guidelines to make their final rulings.
